06/ 18.08.2021 This petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.

Mr. Pandey Ashok Nath Roy, learned counsel appearing for the O.P. No. 2 submits that copy of I.A. No. 3898 of 2020, filed by the petitioner has not been served upon him.

Mr. Randhir Kumar, learned counsel appearing for the petitioner undertakes to serve the copy of I.A. upon Mr. Roy by the end of this week.

Mr. Roy, learned counsel appearing for the O.P. No. 2 seeks two weeks time for filing response to the said I.A.

I.A. No. 3898 of 2020 has been filed for continuation of the interim order dated 24.01.2018. Learned counsel for the petitioner submits that in view of the judgment passed by the Hon'ble Apex Court, in the case of Asian Resurfacing of Road Agency Pvt. Ltd. & Anr. Versus Central Bureau of Investigation, reported in (2018) 16 SCC 299, the aforesaid interlocutory application has been filed.

Considering the aforesaid fact and also the O.P. No. 2 seeks time to file their response, the prayer, made in the interlocutory application is allowed.

Since the criminal miscellaneous petition is pending before this Court, the interim order dated 24.01.2018 is extended till the next date of listing.

The aforesaid interlocutory application stands allowed. Post this case on 21.09.2021.
