4/17.08.2021 This petition has been heard through Video Conferencing in
view of the guidelines of the High Court taking into account the situation
arising due to COVID-19 pandemic.
In view of the Full Bench judgment of this Court in
Cr.Appeal(SJ) No.1281 of 2016 along with analogous cases, this Cr.M.P is
not maintainable.
Accordingly, the instant petition is dismissed as not
maintainable in the light of Full Bench judgment of this Court in
Cr.Appeal(SJ) No.1281 of 2016 along with analogous cases.
Consequently, any I.A pending is also stands dismissed.
The petitioner is, however, at liberty to avail other remedy
in law, if available, and subject to limitation, in which case the time spent
in pursuing this petition shall be accounted for while counting the period
of limitation, if any.
