The second appeal has been preferred against the judgment dated 15.06.2017 and decree signed on dated 22.06.2017 passed by learned District Judge-XI, East Singhbhum at Jamshedpur in Title Appeal No. 27 of 2008, whereby the judgment dated 31.03.2008 and decree signed on 10.04.2008 passed by learned Sub-Ordinate Judge- Vth, at Jamshedpur in Title Suit No. 70/1986 has been reversed.

Office note reveals that defect no. 10 vide S.R. dated 23.11.2017, which is as follows:-

Defec No. 10 - It appears that appellant no. 4 of memo is deceased as per note by learned counsel at bottom of page no. 2, as such, necessary step may be taken by learned counsel in this regard.

Learned counsel for the appellants has prayed for two weeks' time after the physical court starts to remove the defect.

Considering the same, two weeks' time after the physical court starts is granted to appellants to remove the defect as pointed out by the office, failing which, this appeal shall stand dismissed without further reference to the Bench, as the appeal is of the year 2017.
