03/04.08.2021 This petition has been heard through Video Conferencing in view of the
guidelines of the High Court taking into account the situation arising due to
COVID-19 pandemic.
Learned counsel for the petitioners submits that the petitioners are
the father-in-law and mother-in-law respectively and the case has been
instituted under section 498(A) of the I.P.C. He submits that without
application of mind order taking cognizance has been passed. He submits
that the case of the petitioners is covered in the light of judgment in the
case of "Amresh Kumar Dhiraj and Ors. Vs. State of Jharkhand and
Another", reported in 2020 (1) JLJR 199 (Jhr.).
Let notice be issued upon the O.P. No. 2 under registered cover with A/D
as well as by ordinary process for which requisites etc. must be filed within two
weeks.
Post the matter on 11.11.2021.
Till the next date, there shall be stay of further proceeding, so far
petitioners are concerned, in connection with Complaint Case No. 1650 of 2018
pending in the Court of learned Judicial Magistrate, Ist Class, Dhanbad.
