1. Through the medium of the instant application supported with an affidavit, the applicant/appellant seeks the condonation of delay in filing the main appeal.
2. It has been reported by the Registry that a delay of 73 days has occasioned in filing the proposed appeal.
3. Heard learned counsel for the applicant/appellant and considered his submissions.
4. Perused the application which is supported with an affidavit. Also perused the main appeal and the copies of documents enclosed with the same as annexures thereto especially the impugned award.
5. In view of the aforementioned perusal and the consideration of the submissions made by the learned counsel for the applicant/appellant, this Court is of the opinion that it may meet the ends of justice in case the application is allowed and the delay in filing the main appeal is condoned so that the same can be disposed of on its merits.
6. Accordingly, the application is allowed and the delay in filing the main appeal is condoned.
7. This application is disposed of.
Mac App 3/2026 CM (271/2026)
1. Issue notice to the respondents in the main as well as in the interim application returnable by the next date of hearing subject to taking of steps for service within a week's period for filing of response/objections.
2. Heard learned counsel for the applicant/appellant in respect of his prayer for grant of relief in the interim application bearing No. CM 271/2026 and considered his submissions.
3. Perused the interim application which is supported with an affidavit. Also perused the main appeal and the copies of documents enclosed with the same as annexures thereto.
4. List on 23rd March, 2026.
5. In the meantime, subject to any vacation/modification upon the consideration of objections/arguments of the other side and till next date of hearing before the Bench, the execution of the impugned award dated 18.08.2025 passed by the learned MACT, Kupwara on Mact File No. 4/C instituted on 29.04.2011 shall remain stayed subject to the deposit of entire award amount with the interest component by the applicant/appellant with the Registry of this Court within a period of four weeks.
6. The amount, upon being deposited, shall be kept under some profitable fixed deposit scheme initially for a period of six months.
