01. The record reveals that in terms of Order dated 10th

February, 2026, passed by this Court, the respondents

were restrained from establishing the proposed Sewage

Treatment Plant (STP) at/near Friends Colony/Allochi

Bagh, Srinagar.

02. Learned counsel for the petitioners submits that the

order mentioned supra was conveyed to the respondent

no. 3, who has flouted the same with impunity and

feeling aggrieved of the same, the petitioners have

preferred a contempt petition which has been registered

as CCP(S) No. 70/2026, in which, the Court has already

issued the notice in terms of Order dated 3rd April, 2026

and it was further provided that in case of failure on the

part of respondents to comply with the order, they were

to appear personally before the Court to explain their

failure.

03. The petitioner, without waiting for the outcome of the

proceedings of the contempt petition, has filed the

instant application under Section 151 CPC for invoking

the inherent powers of this Court for the purpose of

implementation of the aforesaid order through SHO,

Police Station Shergarih and Senior Suprintendent of

Police, North.

04. Heard learned counsel for the applicants/petitioners and

perused the record.

05. Since the petitioner has already filed a contempt

petition, in which, the Court has already taken

cognizance, therefore, the consideration of instant

application at this stage is deferred for the time being.

06. Registry is directed to list the instant application along

with contempt petition and main petition on 24th April,

2026.
