1. Through the medium of the instant application supported with an affidavit,
the applicant (respondent in the main revision petitions) seeks the release of
the amount of Rs.5 lac/ which has been deposited by the non-applicant
(petitioner in the main petitions) pursuant to the order dated 01.03.2025 of
this Court on the main grounds that the said amount stands deposited as a
part payment towards the amount of fine already awarded vide common
judgment of conviction and order of sentence by the learned trial
Magistrate dated 29.11.2025, payable to the legal heir of the deceased
complainant i.e. the present applicant.
2. Heard the learned counsel for the non-applicant/respondent who resisted
the application on the ground that the deposited amount of Rs.5 lac/- is not
on account of the part payment but as per the terms of the bail order.
3. Perused the application. Also perused the main petitions especially the
order dated 01.03.2025 passed by this Court on the main petitions, order

dated 28.08.2023 passed by the Court of learned 1 st Additional Sessions
Judge, Jammu on appeals and the order dated 29.11.2025 passed by the
learned Special Mobile Magistrate, Jammu on the basic complaints.
4. The perusal of the order dated 01.03.2025 passed by this Court on the main
revision petitions clearly reveals that the amount of Rs.5 lac/- sought to be
released by the applicant/respondent stands deposited by way of a part
payment of fine imposed vide common judgment of conviction and
sentence.
5. It is revealed from the aforesaid order dated 01.03.2025 that the non-
applicant/petitioner has already deposited an amount of ₹16.40 lacs which
stands released in the favour of the applicant/respondent being the sole
legal heir of the basic deceased complainant.
6. The objection raised by the non-applicant/petitioner is not tenable.
7. In the backdrop, the application is allowed and the deposited amount of ₹5
lacs (Rupees five lacs only) is directed to be released by the Registry in
favour of the applicant/respondent namely Pradeep Kumar Puri upon his
identification by his learned counsel against the proper receipt.
8. The application is disposed of.
9. The main revision petitions shall come up for further consideration on
10.02.2026.
