Notice. Mr. Sikandar Bhushan learned Deputy
Advocate General, appears and waives service of notice on
behalf of respondents No.1 to 3.
With the consent of learned counsel for the
appearing parties, matter is taken up for disposal at this
stage.
2. This writ petition has been filed for grant of
following reliefs:
Whether reporters of Local Papers may be allowed to see the judgment? yes
"(i) That writ of mandamus may kindly be issued, directing the respondent authorities to regularize the services of the petitioner as per the prevailing regularization policy from the due date i.e. 2021 with all consequential benefits, in view of the judgment dated 04.07.2024 passed by this Hon'ble Court in CWP No.789/2024, titled as Ram Singh v/s State of H.P. & others, since the respondent department has regularized the services of similar persons i.e. private respondents in the year 2021, but as far as the petitioner is concerned, he was deprived from such service benefit without any justification."
3. Learned counsel for the petitioner submitted that
the case of the petitioner and the relief prayed for by him has
already been considered & adjudicated upon by this Court in
Pyare Lal Vs. State of H.P. & Ors.2, Ram Singh Vs. State
of H.P. and Ors3, Neter Singh Vs. State of H.P. & Ors. 4,
Shiv Kumar Vs. State of H.P. & Ors. 5 and Khub Ram Vs.
State of H.P. & Ors.6. LPA No.60 of 2025, filed by
respondent-State against Ram Singh3 was dismissed on
27.02.2025. Learned counsel also submits that the
representation dated 04.03.2025 (Annexure P-4) preferred by
the petitioner for claiming the above relief is pending
CWP No.1529 of 2020 decided on 08.08.2023
CWP No.789 of 2024, decided on 04.07.2024
CWP No.9085 of 2023 decided on 21.11.2024
CWP No.774 of 2024, decided alongwith connected matters on 27.02.2025
CWP No. 9086 of 2023, decided on 13.03.2025
consideration with respondent No.2. Learned counsel further
submits that the petitioner would be content in case
respondent No.2/competent authority is directed to decide
the aforesaid representation within a fixed time schedule.
Learned Deputy Advocate General is not averse to this prayer.
4. Having regard to the afore-submissions, but
without examining the merits of the matters, this writ petition
is disposed of with a direction to respondent No.2/competent
authority to consider and decide the aforesaid representation
of the petitioner dated 04.03.2025 (Annexure P-4) in
accordance with law as well as taking into consideration the
above judgments within a period of six weeks from today. The
decision so arrived at shall also be communicated to the
petitioner.
The writ petition stands disposed of in the above
terms, so also the pending miscellaneous application(s), if
any.
