By way of instant application, prayer has been

made by the applicant/petitioner for extension of time to

furnish the bank guarantee in terms of order dated 18.8.2023,

passed in CWP No. 5366 of 2023, whereby this Court. while

setting aside order dated 20.4.2023, passed by the Deputy

Labour Officer-cum-Appellate Authority, Shimla, remanded the

case back to the aforesaid authority with a direction to decide

the same afresh, subject to furnishing the bank guarantee

equivalent to the amount determined by the Controlling

Authority within six weeks.

Since within the aforesaid period, petitioner has not

been able to furnish the bank guarantee, it has approached this

Court by way of instant application for extension of time.

For the reasons stated in the application, the same

is allowed and further two weeks' time, from the date of supply

of requisite information by the respondents, as prayed for, is

granted to the applicant/petitioner to furnish the bank

guarantee in terms of order dated 18.8.2023, passed in CWP

No. 5366 of 2023, failing which order dated 20.4.2023, passed

by the Deputy Labour Officer cum Appellate Authority, would

.

automatically revive.

Authority concerned, before whom bank guarantee

is to be furnished, shall make available complete bank account

details, enabling the petitioner to do the needful in terms of

judgment dated 18.8.2023, passed in CWP No. 5366 of

2023.The application is disposed of.
