Vishwa Devi vs. Sandeep Kumar.
.
COPC No. 445 of 2021.
11.05.2022 Present: Mr. Ashok Kumar, Advocate, for the petitioner.
Mr. Ajit Singh Saklani, Advocate, vice Mr. Ajay Kumar
Chauhan, Advocate, for the respondents.
Notice in this contempt petition was issued on
29.11.2021, on which date learned counsel for the respondents
sought time to obtain instructions in the matter. At his request,
the matter was adjourned to 1.4.2022. We are on 11.5.2022.
Even today, the judgment in question has not been complied
with. The matter was listed on 1.4.2022, when the following
order was passed:
"Notice in the Contempt Petition was issued on
29.11.2021. On the said date, learned counsel for the respondents sought time to obtain instructions in the
matter. At his request, the matter was adjourned to 01.04.2022. During hearing of the case today, learned
counsel for the respondents again prayed for adjourning the matter. No reason or justification for adjourning the matter has been placed on record. Neither reply nor compliance affidavit to the contempt petition has been filed till date. At the persuasive request made by learned counsel for the respondent, list the matter on 22nd April, 2022, to enable the respondents to comply with the judgment, failing which appropriate orders in the matter shall be passed."
On the next date, i.e. 22.4.2022, on behalf of the
respondents, it was projected that respondents are in the
process of implementing the judgment in question and for that
reason one more week's time was prayed. The time, as prayed
for, was granted to the respondents to comply with the orders.
.
On 4.5.2022, yet again one more week's time was granted at the
request of the respondents for complying the judgment. The
judgment has still not been complied with.
As the persuasive request made by learned counsel
appearing for the respondents, the matter is ordered to be listed
on 17th May, 2022.
r to It is made clear that in case the judgment is not complied
with by the next date of hearing, appropriate orders shall be
passed in the matter on the next date of hearing. It is also
directed that respondents shall remain present in the Court on
the next date of hearing in case the judgment in question is not
complied with by that time.
