petitioner.

the respondents.

Learned counsel for the petitioner submits

that present petition is squarely covered by the

judgment passed by this Court, in CWPOA No.231 of

2019, titled as Shri Amar Nath and Others Versus

State of Himachal Pradesh and Others.

Learned Additional Advocate General

submits that Letter Patent Appeal has been filed

against the said judgment, which is pending

adjudication and it will be in the interest of justice in

case hearing in the petition is deferred by four weeks.

Learned counsel for the petitioner submits

that though the Latter Patent Appeal has been

preferred by the State against the judgment passed by

this Bench, however, Hon'ble Division Bench has not

been pleased to stay the operation of the judgment.
