ORAL ORDER
1. Pursuant to the issuance of notice, Mr.Lalit Joshi has appeared in person. Mr.Lalit Joshi submits that he has already paid the entire outstanding dues in respect of the electricity connection of the premises in question. He submits that he wants to put an end to the litigation and in view thereof, he has made complete payment. He submits that as on date there are no outstanding dues.
2. Mr.Salil M. Thakore, learned counsel appearing for the petitioner submits upon instructions that they have received the complete electricity dues in respect of the earlier occupant of the premises including delay payment charges. He submits that thereafter new electricity connection has also been granted to the respondent no.2, which is not denied by the respondent no.2 in person.
3. Learned counsel Mr.Thakore for the petitioner submits that in view of the above situation, the impugned judgment and order be set aside in so far as it directs the petitioner to initiate appropriate legal

remedies against the original consumer Shri Nitin Boricha for recovery of the entire outstanding dues since the respondent no.2 has agreed and already paid the said dues.
4. The respondent no.2-Mr.Lalit Joshi has appeared in person has no objection if the said impugned order is set aside so as to put an end to the lis between the parties.
5. In view of the aforesaid submissions of the learned counsel appearing for the petitioner as well as the respondent no.2 in person, the impugned judgment and order is quashed and set aside. The present petition stands disposed of accordingly. No order as to costs.
