Since the issue raised in this petition is squarely covered by the judgment of the Hon'ble Apex Court in case of Dhanasingh Prabhu Vs. Chandrasekar and another, 2025, LawSuit (SC) 928, learned advocate for the petitioner, under the instructions, seeks permission to withdraw present petition. Permission granted. The petition stands disposed of as withdrawn. Rule discharged. Interim relief granted earlier stands vacated. Consequently, Criminal Misc. Application for vacating stay also stands disposed of as not survived.

It is clarified that this Court has not examined the merits of the matter.

Since the proceeding is u/s 138 of the NI Act, the learned trial Court shall follow the recent judgment of the Hon'ble Apex Court in case of Sanjabij Tari Vs. Kishore S Borcar and others, 2025 INSC 1158 and shall proceed to decide the matter as early as possible, preferably within three months from the date of receipt of copy of this order.
