1. By this application, the applicant has prayed for condoning the delay of 24 days caused in preferring the captioned first appeal.

2. Mr.Adnan A Khan, learned Advocate appearing for Mr.Mohsin Hakim, learned Advocate submitted that after the judgment was ready for delivery the applicant took steps. The papers were gathered and information was collected and was provided to the learned Advocate. In the process, there occurred a delay of 24 days. It is urged that the delay is bona fide which may kindly be condoned.

3. The affidavit of direct service is filed indicating that the notice has been served upon the Advocate Mr.I J Haroshi of the respondent as per the order dated 01.09.2025.

4. Though served, the respondent has chosen not to enter appearance.

5. Having regard to the averments made so also the oral submissions, this Court, is of the opinion that delay of 24 days caused in filing the captioned appeal deserves to be condoned and is hereby condoned.

6. Civil application succeeds and is accordingly allowed. Rule is made absolute. No order as to costs.
