                                                            ORAL JUDGMENT

1. Present application is preferred by the Petitioners (Original Accused Numbers 1 and 3) under Section 482 of the Code of Criminal Procedure, seeking quashing of FIR No. I - 67 of 2016 registered with Thara Police Station, Banaskantha for the offences punishable under Section 354 and 506(2) of the Indian Penal Code 1860.

2. Heard learned Advocate for the Applicant, learned APP for the Respondent - State and learned Advocate appearing on behalf of Respondent No.2 - Original Complainant.

3. Rule. Learned APP waives service of notice for and on behalf of the respondent - State and learned Advocate Mr. Parth A. Patel waives service of Rule on behalf of the Original Complainant.

4. Learned Advocate for the Petitioner has submitted that the matter has been amicably settled between the parties and they are now not willing to proceed with the complaint any further.

Leaned Advocate Mr. Patel appearing on behalf of Respondent No. 2 - Dimpalben (Original Complainant), who is present before this Court, has placed on record duly sworn in Affidavit dated 13.11.2025. The same is ordered to be taken on record. Learned Advocate has submitted that matter has been amicably settled between the parties and there is no objection if present application is allowed. The relevant paragraph in the Additional Affidavit reads thus:

" (1) ...I state that the dispute is settled between the parties and I have no objection if the aforesaid F.I.R. and other consequential proceedings registered against the petitioner is quashed. I further state that the misunderstanding which had occurred between my family and the petitioner is resolved. I state that petitioner and respondent no.2 are husband and wife, and out of their wedlock two children have born, namely Diyana (Age : 5 years) and Pihu (Age : 6 months). I state that in view of the aforesaid facts and circumstanes, since, there is no grievance remains between the parties. Therefore, the impugned F.I.R. may be quashed and set-

aside in the interest of justice."

6. Considering averments made in the Affidavit as also the submissions made by the learned Advocates for the respective parties, the present Application deserves to be allowed and is hereby allowed. The FIR No. I - 67 of 2016 registered with Thara Police Station, Banaskantha for the offences punishable under Section 354 and 506(2) of the Indian Penal Code 1860 is hereby quashed and set aside qua the present Petitioner. Rule is made absolute.
