                                                             ORAL ORDER

1. Heard Ms. Kirti Pathak, learned advocate on record for the

appellant-Insurance Company.

2. Learned advocate has mainly referred to the grounds raised in

the appeal memo, and has urged this Court to admit the appeal.

3. I have considered the submissions made by learned advocate for

the appellant, in light of the grounds raised in the appeal. However,

noticing the fact that the present appeal is valued less than Rs.3

Lakhs, this Court is not inclined to entertain the appeal, noticing the

fact that the interest of the appellant-Insurance Company has been

considered by the Tribunal, while passing the impugned judgment and

award by observing that it shall be open for the appellant-Insurance

Company to seek recovery of the amount deposited.

4. Considering the aforesaid facts, this Court is not inclined to

entertain the present appeal solely on the ground of smallness of the

amount.

5. It is clarified that dismissal of the present appeal shall not be a

precedent as regards the impugned judgment and award being

assailed in the cognate appeals.

6. With these observations, present First Appeal stands disposed

of. Connected Civil Application for stay stands disposed of,

accordingly.
