1. Learned advocate Ms. Punita Joshi for learned advocate Mr. Harsh M. Surti appearing for the applicants submits that, in the factual circumstances that the trial has already commenced and matter is at the stage of evidence of the prosecution as it is discerned from the report of the learned trial Court, she seeks permission to withdraw both the applications with a relief to expedite the trial before the learned trial Court.

2. In view of above, permission as prayed for is granted, both the Criminal Misc. Applications stand disposed of as withdrawn, with the direction that the learned trial Court shall endeavour to complete the trial within 01 year from the date of receipt of the copy of this order.

3. The offence is under Sections 406 and 420 of the Indian Penal Code, having maximum punishment of less than 7 years, and therefore, the learned trial Court shall follow the judgment in the case of Arnesh Kumar v. State of Bihar, reported in (2014) 8 SCC 273 and if required, can take the bond and surety from the present applicants for securing their presence during the trial.

4. It is needless to say that all the rights and contentions are kept open before the trial Court.
