1. At the outset, learned Assistant Government Pleader Mr.Trivedi, has submitted that on a similar issue, the Division Bench vide order dated 17.01.2024, passed in Letters Patent Appeal No.1402 of 2023 has admitted the matter and the judgment and order passed by the learned Single Judge is stayed.

2. Though the respondent No.1 has already been served on 17.02.2024, he has chosen not to appear. Thus, the averments made in the application explaining the delay of 329 days remained uncontroverted.

3. Thus, the delay of 329 days is condoned. The present civil application for condonation of delay is allowed. The
