  CORAM:HONOURABLE MR. JUSTICE J. C. DOSHI

                              Date : 03/10/2023

                                ORAL ORDER

Learned Senior Counsel Mr. Shalin Mehta assisted by learned advocate Mr. Nirad Buch for the petitioners seeks permission to withdraw present petition on the ground that the petitioners are in process of challenging the order of rejection of the plaint being Special Civil Suit No.4 of 2023 by the competent court at Vadodara. He would further submit that if order in appeal would favour the present petitioners, it would give cause of action to the petitioners to file petition again.

Considering above submission, the petitioners are permitted to withdraw present petition with a liberty to file petition after disposal of the appellate proceedings emanating from the judgment and decree passed in Special Civil Suit No.4 of 2023, provided that they are in favour of the petitioners.

(J. C. DOSHI,J) SHEKHAR P. BARVE
