1. Heard learned Advocate for learned Advocate for Ms. Kirti S.

Pathak for the applicant. Though served none appears on behalf of the

opponents.

2. By way of this application, the applicant prays for condonation of

delay of 128 days which has occurred in filing the first appeal against

judgment and order passed by the Commissioner Workmen

compensation, Kalol dated 28.10.2021.

3. Considering the submissions made by learned Advocate for the

applicant and having regard to the averments on record, sufficient cause

C/CA/2958/2022 ORDER DATED: 25/01/2023

for condonation of delay having been made out, the application deserves

consideration.

4. In view of the same, the delay of 128 days in preferring delay

stands condoned. The application stands allowed. Rule is made absolute

to the aforesaid extent.
