today, the Hon'ble Court has been pleased to pass the following

order:-

"In view of the aforesaid discussion, the appeal is allowed. The impugned judgment and order dated 04.09.2009 passed by the Special Judge (Electricity) in Special Electricity Case No.24 of 2008 is quashed and set aside. The appellant is ordered to be set at liberty, if not required in any other offence. Bail bond of the appellant stands discharged. R & P to be sent back to the concerned trial Court.
