This is an application for leave to appeal filed under Section 378(4) of Criminal Procedure Code, 1973 challenging the judgment and order dated 01.10.2021 passed by the 18th Additional Chief Judicial Magistrate, Surat in Criminal Case No. 44439 of 2015, wherein learned Magistrate was pleased to acquit the respondent-accused from the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.
