Heard learned advocate for the applicant.
Mr.Dhruv Dave, learned advocate for the applicant seeks permission to delete respondent No.1, who happens to be driver of the offending vehicle. Though served, none appears on behalf of respondent Nos.2 and 3.
permission as prayed for is granted. The amendment to be carried out forthwith.
The present application under Section 5 of the Limitation Act is preferred to condone the delay which is occurred in preferring First Appeal to assail the impugned judgment and award.
Considering the averments made in this application, the delay is condoned. The application stands disposed of. Rule is made absolute.
