Heard Mr. Dakshesh Mehta, learned advocate for the applicant.

Respondent Nos.3 & 5 are the owners of the respective offending vehicles, are not served. However, the presence is not required for the purpose of disposal of the present application.

The present application is filed for condonation of delay occurred in preferring the first appeal to assail the judgment and order dated 18.06.2018 passed by learned MACT (Aux.III) Gandhinagar in MACP No.137/2007.

For the reasons stated in the application, the same is allowed. Delay in preferring the First Appeal is condoned. Rule is made absolute.
