Heard Mr. Hemal Shah, learned advocate for the

applicant and Mr. Sunal B. Parikh, learned advocate for

the respondent No.2. There is no appearance on behalf of

the respondent No. 1.

Present application is preferred for condonation of

delay which has occurred in preferring appeal to

challenge the impugned judgment and award passed by

the Tribunal.

Considering the averments made in the application

and the facts of the case, delay is hereby condoned. The

application is allowed. Rule is made absolute to the

aforesaid extent.
