Heard learned advocate Mr. Bhavin Thaker on behalf of learned advocate Mr. Maulik Shelat for the applicant­ Appellant and learned advocate Mr. Mrudul Barot on behalf of respondent No.1. Though served nobody appeared for respondent Nos. 3 and 5.

By way of this application, the applicant prays to condone delay of 20 days which has occurred in filing the First Appeal challenging the judgment and award dated 30.09.2019 passed by MACT (Main), Bhavnagar in MACP No. 116/2015.

Learned advocate Mr. Mrudul Barot for the respondent No.1 has vehemently opposed the application.

Considering the submissions made by learned advocate Mr. Thaker and considering the averments made in the application, this Court is of the opinion that delay caused is sufficiently explained and, therefore, the same is condoned. The Application is allowed.
