The present First Appeal under Section 173 of the Motor Vehicles Act, 1988 has been preferred by the appellant­original opponent No.3 challenging the judgment and award passed by the Motor Accident Claims Tribunal (Aux.), Patan dated 24.10.2018 in M.A.C.P. No.376 of 2011 and allied petition, by which the Tribunal has awarded a sum of Rs.1,00,000/­ only to the original claimants towards the compensation for the accident involved and the damage caused to the vehicle ­ Accent Car bearing Reg. No.MH­1­CA­ 8279 of the original claimants.

C/FA/2630/2019 ORDER

At the outset, it is required to be noted that the amount involved is only Rs.1,00,000/­. Considering the fact that the amount involved is too small, on the ground of smallness of the amount involved, the present First Appeal is dismissed. No order as to costs.

As a consequence, the connected civil application for stay does not survive and the same also stands disposed of.
