1 We have heard Shri A.V.Nair, learned counsel for the appellant and Shri P.J.Mehta, learned counsel for the respondent on caveat.

2 This appeal by the Regional Provident Fund Commissioner, Regional Office, Ahmedabad according to our considered view would not be maintainable as the Employees Provident Fund Office is not aggrieved by the judgment of the learned Single Judge. All the directions issued by the learned Single Judge and the liability fastened are on the employer and not on the Employees

C/LPA/37/2021 ORDER

Provident Fund Office. The only direction issued to the Employees Provident Fund Office is to make an internal inquiry and find out the defaulting officers because of whom the payment got delayed. This cannot be a grievance to be considered in an appeal as admittedly there has been a delay in making payments.

3 Shri Nair has also placed before us an office note dated 14.12.2020, according to which, supplementary payment of Provident Fund and the interest liability has been credited to the account of the employees.

4 We do not find any reason to entertain this appeal and is accordingly dismissed. Consequently, connected Civil Application also stands disposed of.
