Heard Mr. A. Ahmed, the learned counsel for the petitioner. Also heard Mr. B. Sharma, the learned Additional Public Prosecutor appearing on behalf of the State respondent and Mr. D. Das, the learned Senior Advocate assisted by Mr. I. Page No.# 2/2

Hazarika, the learned counsel for the informant.

2. Case Diary received in this case. But, it is submitted by Mr. Sharma that the statement of the present petitioner is not available in the Case Diary. However, he submitted that the order of the interim bail granted to the present petitioner is available in the case record but, there is not note of the I/O as to why the statement of the petitioner could not be recorded.

3. In that context, Mr. Ahmed submitted that as per their information the petitioner has already appeared before the I/O and their statement is recorded.

4. In view of above, let the updated Case diary be called for along with the statement of the present petitioner recorded, if any, and in the event the statement of the petitioner is not recorded by the I/O, he is directed to record the statement of the petitioner within 7 (seven) days from the date of order and the petitioner is also hereby directed to appear before the police station for recording his statement, if not recorded yet.

5. In view of this, Case Diary be returned.

6. Let the updated Case Diary be called for.

7. List the matter accordingly on 26.03.2026.

8. Interim be extended till next date of listing.
