Heard Mr. AM Barbhuiya, learned counsel for the petitioner. Also heard Mr.
TC Chutia, learned Additional Senior Government Advocate, Assam and Ms. B.
Deka, learned Standing Counsel, Elementary Education Department for the
respondent nos. 2 & 7.
The grievance in the writ petition is for non-consideration of the petitioner's
claim for compassionate appointment by the State Level Committee (SLC).
Learned counsel for the petitioner has placed before the Court the order dated
23.05.2025 passed in WP(C) No.2755 of 2025 disposing of the said writ petition.
Learned counsel for the petitioner submits that the present writ petition can also
be disposed of in terms of the said order.
A perusal of the order reflects that the order dated 23.05.2025 passed by the
Co-ordinate Bench in WP(C) No.2755 of 2025, was a consent order. There was a
consensus before the Court that the petitioner's case in that writ petition stood
covered by the Judgment and Order dated 03.04.2025 passed by another Page No.# 3/3
Coordinate Bench in WP(C) No.342/2025 and other batch of connected writ
petitions.
Mr. TC Chutia, learned Additional Senior Government Advocate, Assam, on the
other hand, disputes the contention of the petitioner and submits that once the
Office Memorandum dated 18.09.2024 and the subsequent executive order
dated 30.08.2025 have been issued, the matter will require consideration and
he therefore prays for some time to complete his instructions and file affidavit.
Considering the submissions made by the learned counsel for the parties, let the
matter be listed after 4 (four) weeks.
Mr. TC Chutia, learned Additional Senior Government Advocate, Assam may
complete his instructions and file necessary affidavit.
