                                        ORDER

26-03-2025 (S. K. Medhi, J) Heard Shri K. P. Pathak, learned Legal Aid Counsel for the applicant, who has filed this application under Section 5 of the Limitation Act, 1963 for condonation of delay of 46 days in preferring the connected appeal.

The appeal has been preferred against the impugned judgment and order dated 11.11.2024 passed by the learned Addl. Sessions Judge-cum-Sessions Judge (POCSO), Tinsukia in POCSO Case No. 104/2023 whereby the applicant was convicted under Section 376 (1) of the IPC and sentenced to undergo RI for 20 years and also to pay a fine of Rs.10,000/- in default of which he was to undergo further imprisonment of 4 months.

Let notice be issued, returnable by 6 (six) weeks. Ms. S. Jahan, learned Addl. PP, Assam accepts notice on behalf of the State respondent.

Let steps be taken for service of notice upon the respondent no. 2 in the manner prescribed which is to be routed through the Office of the learned PP, Assam within 2 (two) working days.

Objection, if any, may be filed in the meantime. List after 6 (six) weeks along with the service report.
