Heard Mr. M. J. Quadir, learned counsel for the petitioner. Also heard Mr. T.C. Chutia, learned Additional Senior Government Advocate for the State and Mr. R. Dhar, learned Standing Counsel for the PWD.

At a joint request of the learned counsel for the parties matter to be listed after three weeks as it is submitted that the Office Memorandum dated 18.09.2024 is under challenge before the Co-ordinate Bench of this Court, by which the Government of Assam has taken a decision that there shall be no further appointment made under the compassionate ground for those Government employees who expired before 2017. This Office Memorandum has been brought out following the judgment of the Apex Court in State of West Bengal Vs. Debabrata Tiwari & Ors. in Civil Appeal No. 8842 & 8855 of 2022 .

The learned counsel for the respondents submits that this Office Memorandum is under challenged before the Co-ordinate Bench of this Court and therefore this matter be deferred so that the status of the those writ petitions can be placed before the Court and thereafter the matter can be decided.

The prayer made is not objected by the learned counsel for the petitioner.

List this matter after four weeks.
