This is an Appeal filed under Section 173 of the Motor Vehicles Act, 1988 challenging the judgment and award dated 20.12.2024 passed by the learned Member, Motor Accident Claims Tribunal No.3, Kamrup (M) at Guwahati in MAC Case No.2004/2019 whereby the Appellant Insurance Company was saddled with the liability of Rs.18,22,623/- along with interest @ 9% per annum from the date of filing of the claim petition.
2. Mr. K. K. Bhatta, the learned counsel appearing on behalf of the appellant submitted that the claimant was the second driver and as the terms of the insurance policy did not include the second driver, the Insurance Company could not have been saddled with the liability. This aspect of the matter was duly argued before the learned Tribunal, but the learned Tribunal did not decide the same while passing the impugned judgment and award dated 20.12.2024 in MAC Case No.2004/2019.

3. Taking into account the said ground, the instant Appeal is admitted.
