Mr. M Talukdar, learned counsel appears for respondent No. 1.
Office note dated 30.11.2023 indicates that the A/D cards as well as un-served reports of service on respondent No. 2 & 3 has not been received back.
Mr. T Kalita, learned counsel for the appellant is allowed to take steps on respondent No. 2 & 3 by dasti service and to file an affidavit thereafter.
Having gone through the pleadings it is seen that the appellant is not challenging the impugned judgment and award dated 28.01.2021 in MAC Case No. 04/2014 on the quantum but regarding the question of liability. Accordingly, this Court is of the view that the ingredients for settlement are not present in this Case.
Accordingly, list the matter after 4(four) weeks awaiting notice on the respondent No. 2 & 3.
