This is an application filed for appointment of an Arbitrator inasmuch as the Arbitrator so directed to be appointed vide the judgment and order passed by this Court on 23.05.2023 in WP(C) No. 6414/2013, had resigned.

2. Mr. R.K.D. Choudhury, the learned Dy. SGI, has placed before this Court a Notification dated 22.10.2024 whereby the Central Government had already appointed the Arbitrator to act in terms with Section 3G(5) of the National Highways Act, 1956. The said Notification is kept on record and marked with the letter "X".

3. Taking into account the above, the instant application stands closed as it has become infructuous.
