Heard Mr. A. Ganguly, learned counsel for the appellants who has filed the
instant regular Second appeal against the Judgment and Order dated
22.02.2024 passed by the learned Civil Judge (Sr. Div), Sonitpur, Tezpur in
Misc(J) Case No.11/2021 arising out of T.A. Case No.02/2021, by which the
petition No.387/2021 was filed by the appellants under Section 5 of the
Limitation Act for condoning the delay in preferring the appeal under Order 41
Rules 1 and 2 read with Rule 3A of the CPC, which was dismissed and confirmed
the Judgment and Decree dated 16.03.2019 passed by the Munsiff No.1, Tezpur
in T.S. No.33/2014.
On hearing the submissions made by learned counsel for the appellants,
the following Substantial questions of law are framed:
A. Whether the finding of the Ld. First Appellate Court that the
Appellants were negligent and delayed in filing the Title Appeal No.02/2021
under Order 41 Rule 1 CPC is perverse and erroneous?
B. Whether the impugned Judgment and Decree dated 22.02.2024 is
liable to be set aside as being null and void, on account of the death of the
original Appellant No.1, Hasen Ali on 23.01.2023, during the pendency of the
Appeal?
C. Whether the Appellants 1 to 9 can be non suited on account of
the failure of their engaged counsel to perform his duty under Order 22 Rule
