1. Heard Mr. S Dey, learned counsel for the petitioner. Also heard Mr. B Sarma, learned Additional Public Prosecutor for the State of Assam.

2. This Interlocutory Application has been filed under Section 430(1) of the BNSS, 2023, by the petitioner, namely, Sri. Abdul Hussain @ Abul Hussain praying for suspension of execution of sentence imposed on the petitioner by the judgment dated 20.03.2025 passed by Ld. Special Judge, Lakhimpur in Special NDPS Case No. 10/2022 and also for bail during the pendency of the connected Criminal Appeal No. 210/2025 wherein the applicant has impugned the aforesaid judgment.

3. Mr. B Sarma, learned Additional Public Prosecutor for the State of Assam has submitted that he has not been furnished with the copy of Interlocutory Application along with annexures.

4. The petitioner is directed to furnish a copy of Interlocutory Application along with annexure to the learned Additional Public Prosecutor within 2(two) days from the date of this order.

5. Let this case be listed again on 20.08.2025.
