Heard Mr. G. Baishya, learned counsel for the appellants.

The regular second Appeal is admitted for hearing upon the following 2(two) substantial questions of law:

i. Whether the findings of the learned first appellate court in affirming the judgment and decree passed by the learned trial court are perverse due to non framing of proper and necessary issue in deciding the real dispute between the parties?

ii. Whether the plaintiffs/appellants denied fair trail by the learned courts below by deciding the suit of the plaintiffs/appellants as a suit easement not a suit of right, title and interest?
