1. Heard Mr. B.P. Borah, learned counsel for the revision petitioners.

2. The instant criminal revision petition has been filed under Section 438/442 of BNSS, 2023, aggrieved by the appellate judgment dated 04.10.2024, passed by Court of learned Sessions Judge, Bajali in Criminal Appeal No.12/2023, whereby the impugned judgment and order dated 31.08.2023, passed by the Court of learned Judicial Magistrate, First Class, Bajali in GR Case No.666/2015 was affirmed upholding the conviction of the petitioner no.1 under Section 341 of IPC including the sentence of S.I for 15 days; the learned Appellate Court was also pleased to uphold the conviction of petitioner no.2 under Section 324 of IPC, including the sentence of S.I for 4 months and fine of Rs.3,000/-(Rupees three thousand only) in (default S.I of 2 months).
3. The revision petition is admitted for hearing.
4. The copies may be served to the learned prosecution/respondent no.1.
5. The petitioner shall take steps for issuance of notice upon respondent no.2 i.e. Sri Homeswar Das.
6. Call for the trial court record from the Court of learned Judicial Magistrate, First Class, Bajali in GR Case No.666/2015.
7. The revision petitioners are stated to be on bail.
8. Considering the nature of the sentence, it is directed that till disposal of this revision petition, the execution of order of sentence dated 04.10.2024, passed in Criminal Appeal No.12/2023 by Court of learned Sessions Judge, Bajali shall remain suspended and the petitioners are allowed to remain on bail.
