The present application is filed under Section 389(3) of the Code of Criminal Procedure, 1973 for suspension of the impugned Judgment dated 06.04.2024 passed in Special Case No. 39/2008 by the learned Special Judge, Additional Court No. 3, CBI, Assam convicting the appellant and sentence to RI for two years under Section 13(1)

(d) read with Section 13(2) of PC Act, 1988, and fine of Rs. 50,000/- and in default SI for two months and sentencing of two years RI on each count under Section 120B/420/468/471 IPC and fine of Rs. 20,000/- on each count, in default further RI for three months on each court and sentence to RI for three years under Section 467 IPC and fine of Rs. 50,000/- in default further RI for six months.

Perused the statement made in the application.

Considering the period of sentence as well as considering that there is no immediate likelihood of taking up this matter for final hearing, it is provided that the impugned sentence dated 06.04.2024 passed in Special Case No. 39/2008 by the learned Special Judge, Additional Court No. 3, CBI, Assam shall remain suspended and the applicant be allowed to remain on previous bail granted by the learned trial Court till disposal of the appeal.

Accordingly, this IA stands disposed of.
