This appeal under section 28(1)(2) of the Hindu Marriage Act, 1955 is directed against the judgment, order and decree dated 12.06.2023 passed by the learned Principal Judge, Family Court, Nalbari in MS(D) 117/2021.
Appeal is admitted for hearing.
Call for the records.
Issue notice returnable in 4(four) weeks.
The appellant shall take steps within 2(two) days for service of notice on the respondent by registered post with 2(two) days as well as by usual process.
The learned counsel for the appellant has submitted that due to oversight the interlocutory application for stay has not been filed and he prays for liberty to file the same in the meanwhile.
Prayer is allowed.
