Heard the learned counsel for the parties.
This interlocutory application has been filed seeking condonation of a delay of 475 days in preferring the connected review petition against the judgment & order dated 04.01.2022 passed in Writ Appeal No.280/2021.
We have also perused the grounds urged seeking condonation of the delay.
Writ Appeal No.280/2021 came to be dismissed by Division Bench of this Court vide order dated 04.01.2022. However, it is stated in the application that the applicant/review petitioner came to be aware of the said judgment only on 12.07.2023 when he came to Guwahati for some personal work. The only ground taken by the applicant/review petitioner is that the counsel could not contact him to inform him about the fate of the case. No details are furnished as to when the counsel had made attempts to contact the applicant/review petitioner and when the letter was issued and posted, etc. It may be mentioned that orders passed by any Court are uploaded by the Registry, are available in Page No.# 3/3
the web portal of the Gauhati High Court to enable litigant public to be apprised of order(s) passed in their matters.
Under such circumstances, in absence of any specific details furnished as referred above we are not inclined to condone the delay prayed for. The interlocutory application is accordingly rejected.
Consequently, the review petition, which is yet to be registered and numbered, is also dismissed.
