Heard the learned counsel Mr. S.K. Ghosh appearing for the appellants.

The appeal is admitted for hearing upon the following four substantial questions of law.

1. Whether the learned Lower Appellate Court erred in law in dismissing the suit of the plaintiffs by holding that the plaintiffs being strangers having no legal character nor have any locus standi to institute the suit without considering the provision of Section 91 of the Code of Civil Procedure?

2. Whether the Lower Appellate Court erred in law in dismissing the suit of the plaintiffs on the ground that the plaintiffs have no locus standi to file the suit under Order 1 Rule 8 CPC read with Section 34 of the Specific Relief Act?

3. Whether the learned Lower Appellate Court erred in law in passing the impugned judgment without considering the provision of order XLI Rule 31 of the Code of Civil Procedure?

4. Whether the defendant no.1 has acquired any right, title and interest on the basis of Ext.2?
