Heard Mr. A.K. Purkayastha, learned counsel for the applicant.

This interlocutory application under Order 41 Rule 5 of the C.P.C. has been filed for stay of execution of the impugned Judgment and Decree, dated 14.06.2017, passed by the learned Munsiff No. 1, Morigaon in T.S. No. 82/2014 in decreeing the suit and in dismissing the counter claim filed by the applicant as well as the execution of the impugned Judgment and Decree, dated 17.09.2018, passed by the learned Civil Judge, Morigaon in T.A. 20/2017 in dismissing the said T.A. No. 20/2017 and confirming the impugned Judgment and Decree, dated 14.06.2017 passed by the learned Munsiff No. 1, Morigaon in T.S. No. 82/2014.

Issue notice. Steps be taken by registered post with A/D within 5(five) days.

List after the ensuing Bihu vacation.

Till the returnable date, it is provided that the execution of the impugned Judgment and Decree, dated 14.06.2017, passed by the learned Munsiff No. 1, Morigaon in T.S. No. 82/2014 shall remain stayed.
