15.02.2022 This is an application under Section 5 of the Limitation Act for condonation of delay in filing the connected revision petition. The connected revision petition is filed assailing the judgment dated 15.05.2019 passed by the Debt Recovery Tribunal, North Eastern Region, Guwahati in OA No. 20/2015 whereby a recovery certificate in favour of the respondent Bank for a sum of Rs. 44,03,648.32/- against the present petitioner was issued.

The learned counsel for the petitioner submits that an appeal lies to the Debt Recovery Appellate Tribunal under the provision of Section 20 of the Recovery of the Debts Due to the Banks and Financial Institutions Act, 1993. Accordingly, the learned counsel for the petitioner prays to withdraw this petition with a liberty to approach the appropriate forum. Prayer is allowed.

This petition is dismissed on withdrawal.
