13.08.2022 This is an appeal filed by the claimants against the judgment and award dated 22.05.2018 passed by the Motor Accidents Claims Tribunal (MACT) No. 3, Kamrup (M) in MAC Case No.1268/2015.
The Bajaj Alliance General Insurance Company Limited (for short Insurance Company) is represented by Shri Nayan Choudhury, Senior Executive Officer.
The claimants are represented by Shri S. Alom, the learned counsel.
The parties present before this Court jointly submit that the matter has been settled outside the Court and an amount of Rs.4,60,356/- (Rupees Four Lakh Sixty Thousand Three Hundred Fifty Six) as full and final settlement has been agreed. It is submitted that during the pendency of this appeal, an amount of Rs.60,356/- (Rupees Page No.# 3/3
Sixty Thousand Three Hundred Fifty Six) has already been paid.
In view of the above, the appeal stands closed with a direction that the Insurance Company shall now deposit the balance amount of Rs.4,00,000/- (Rupees Four Lakhs), being the full and final settlement before the Registry of this Court within a period of 45 days from today. The balance amount be released in the name of the claimant no. 1 and the amount would be released to the claimant on being properly identified by the learned counsel for the claimant.
A memo of settlement is made a part of the record.
The MAC Appeal accordingly stands disposed of.
