Heard Mr. R Mazumdar, learned counsel appearing on behalf of Mr. S Das, learned counsel for the petitioners who submits that the petitioners have been engaged as Tax Collectors/Road Moharar and office peon on casual basis in different Gaon Panchayats under the jurisdiction of Respondent No.4 prior to 01.09.2005. However, their names are not included in the pre-AFRBM list and as such, they have not been given the minimum scale of pay in terms of paragraph-22 of the Judgment of the Division Bench in the case of State of Assam & Ors-vs- Sri Upen Das & 836 others in WA 45/2014.
On the prayer made by the learned counsel for the petitioner, Commissioner & Secretary to the Government of Assam, Finance Department is impleaded as respondent No.5.
Registry to make necessary correction in the Cause Title.
Issue notice, returnable in 4(four) weeks.
Mr. A Bhattacharjee, learned counsel accepts notice on behalf of respondent Nos. 1 to 4 and Mr. P Nayak accepts notice on behalf of respondent No.5.
