This petition under Section 401 read with Section 482 of the Cr.P.C. is directed against the judgment and order dated 26.03.2021, passed by the learned Additional Sessions Judge, FTC, No. 3, Kamrup (M), Guwahati, in Page No.# 2/3

Criminal Appeal No. 180/2019.

It is to be mentioned here that vide impugned judgment and order, dated 26.03.2021, the learned Additional Sessions Judge, FTC, No. 3, Kamrup (M), Guwahati, has upheld the judgment and order, dated 09.09.2019, passed by the learned JMFC, Kamrup (M), Guwahati, in C.R. Case No. 2580/2017.

Heard Mr. M. K. Borah, learned counsel for the petitioner.

Also perused the documents placed on record.

Issue notice, returnable within 4 (four) weeks.

Steps for causing service of notice upon the sole respondent be taken by registered post with A/D as well as by usual process.

Call for the scanned copy of the record from the learned Court below.

Pending disposal of this petition, operation of the impugned judgment and order dated 26.03.2021, passed by the learned Additional Sessions Judge, FTC, No. 3, Kamrup (M), Guwahati, in Criminal Appeal No. 180/2019, stands stayed.

The learned counsel for the petitioner submits that till disposal of the Appeal, the petitioner may be allowed to remain on previous bail.

Prayer is, accordingly, allowed.
