This jail appeal is preferred against the judgment and sentence dated 16.12.2019 passed by the learned Special Judge, Nalbari, Assam in NDPS Case No.11/2018 convicting the appellant under section 20(b)(ii)(c) of the NDPS Act and sentencing him to undergo Page No.# 2/2

Rigorous Imprisonment for 12 years and fine of Rs.1,50,000/- with default stipulation.

Admit.

Notice be issued to the first informant.

We appoint Mr. A. Kalita as Amicus Curiae in the case, having regard to the judgment dated 18.12.2019, passed by the Supreme Court of India in Anokhilal v. State of Madhya Pradesh, reported in (2019) 20 SCC 196. In terms of the directions in the said order, we also grant permission to the Amicus Curiae to have meetings and discussions with the concerned accused.

Let the lower court records with reference to the case number, as indicated above, be requisitioned forthwith.

On receipt of the said records, Office shall take steps for preparation of the Paper Book, copies of which be furnished to the Amicus Curiae as well as to Ms. B. Bhuyan, learned Additional Public Prosecutor, Assam.
