                                             ORDER

26.02.2021 Heard Mr. R. Ali, learned counsel appearing for the appellants.

Appeal is admitted for hearing upon the following three substantial question of law:-

1. Whether the L/d. Court below was correct by holding that "the defendants have encroached upon the suit land and they dispossessed the plaintiff therefrom" without proof of actual status/identification of the land possessing by the Appellants/Defendants?

2. Whether both the L/d. Court below was correct in ignoring specific admission of both PW-1 & PW-2 (regarding identification of the suit land), while deciding both title and possession of the suit land in favour of the Plaintiff/respondent?

3. Whether the impugned Judgment & Decree contravenes the mandate of Order 41 Rule 31 of the Code of Civil Procedure, 1908? Issue Notice to the respondent.

The appellants shall take steps for service of notice upon the respondent by registered post with A/D as well as by usual process.

Call for the LCR.

Upon receipt of the LCR, matter shall be listed after 4(four) weeks, on a date to be fixed by the Office.
